Lotta Lettuce Litigation Lands on 'Fox & Friends'

Farm owner Todd Kuehm says he's been unable to use his property because of Montville Township's use of eminent domain.

A farmer who owns property on Jacksonville Road in Montville Township appeared with his attorney on "Fox & Friends" Friday morning to discuss ongoing litigation between the farmer and the township that has lasted about eight years.

Since 2003, Todd Kuehm has been "locked in a legal battle with his local town over his own property," show host Steve Doocy said.

"Using eminent domain, (Montville) took part of Todd's land for government use," Doocy said.

Kuehm said the town offered him $1,000 for a well, but that the well is worth far more than that to him because it allows him to water his crops.

The town has decided it doesn't want to use the land, but they haven't agreed on what Kuehm should be paid for any hardship, Kuehm said.

Kuehm's attorney Anthony Della Pelle said the property in the Towaco section of the township sits on a substantial amount of ground water, which he said the state gave Kuehm a permit to use. The water makes the land more valuable, Della Pelle said.

The town has taken repeated actions to stop him from using the property, the attorney said.

"I want it to be over," said Kuehm, who described himself as a fourth-generation farmer. "I want to grow vegtables." Kuehm appeared on the show with his attorney, Anthony Della Pelle.
